HIPAA Notice of Privacy Practices

Our Commitment
NOW Mental Health is committed to protecting the privacy of your health information. This notice describes our privacy practices and your rights regarding your protected health information (PHI) under the Health Insurance Portability and Accountability Act of 1996 (HIPAA).
How We May Use and Disclose Your PHI
We may use and disclose your PHI for the following purposes:
- Treatment: To provide, coordinate, or manage your mental health care, including consultations with other providers, referrals, and treatment planning.
- Payment: To bill and collect payment for your treatment, including submitting claims to your health insurance plan.
- Healthcare Operations: For quality improvement, staff training, and administrative operations necessary to run our practice.
- As Required by Law: When required by federal, state, or local law.
- Health and Safety: To prevent or lessen a serious and imminent threat to your health or safety or the health and safety of others.
Special Protections for Mental Health Records
Psychotherapy notes receive additional protection under HIPAA. We will not disclose psychotherapy notes without your written authorization except in limited circumstances permitted by law (such as to defend ourselves in legal proceedings or for mandated oversight activities).
Your Rights
- Right to Access: You may request to inspect and obtain a copy of your PHI.
- Right to Amend: You may request amendments to your PHI if you believe it is inaccurate or incomplete.
- Right to Restrict: You may request restrictions on certain uses and disclosures of your PHI.
- Right to Confidential Communications: You may request that we communicate with you by alternative means or at alternative locations.
- Right to an Accounting: You may request a list of certain disclosures we have made of your PHI.
- Right to a Copy of This Notice: You may request a paper copy of this notice at any time.
- Right to File a Complaint: You may file a complaint with us or with the Secretary of the U.S. Department of Health and Human Services if you believe your privacy rights have been violated.
Telehealth Privacy
When you use our telehealth services, your PHI is transmitted using encrypted, HIPAA-compliant technology. We take reasonable steps to ensure the security of your information during electronic communication, but no method of electronic transmission is 100% secure.
Changes to This Notice
We reserve the right to change this notice and to make the revised notice effective for PHI we already have about you as well as any information we receive in the future. We will post a copy of the current notice on our website and in our office.
